In 1947, the Cornell psychiatrist Keeve Brodman and a handful of colleagues began developing what would become one of the most widely used health questionnaires of its time—the Cornell Medical Index (CMI). A rigidly standardized form, the CMI presented 195 yes-no questions designed to capture the health status of “the total patient.” Over the following decades, Brodman’s project of standardizing medical history taking gradually evolved into a project of mathematizing and computerizing diagnosis: out of the CMI grew the Medical Data (...) Screen (MDS), one of the first computerized methods of deriving diagnoses from patient data. This essay follows the life course of these tools through the second half of the twentieth century. It argues for a genealogy of biomedical computing and computerized diagnosis that takes more seriously the continuities between computer-based digital practices and paper-based analog ones. The computerized MDS evolved from, and rested upon, paper data practices associated with questionnaires and surveys. The interlocking histories of the CMI and the MDS prompt a reconsideration of the material and temporal parameters within which the history of computerized medicine has conventionally been understood. Some have proposed that it is reasonable for an atheist to pursue a form of life shaped by engagement with theistic religious language and practice, once language and belief in God are interpreted in the appropriate non-realist manner. My aim is to defend this proposal in the face of several objections that have been raised against it. First, I engage in some conceptual spadework to distinguish more clearly some varieties of religious non-realism. Then, in response to two central objections, I (...) seek to articulate the most promising version of the view. Traditionally, the fiduciary duty of loyalty is implicated where corporate directors have conflicts of interest. In a major new decision, Stone v. Ritter, the Delaware Supreme Court determined that directors may also be disloyal when they act in bad faith. As a consequence, directors may be disloyal even when they have no conflicts of interest, and even when they intend to benefit their corporation. This Article reconciles this expanded fiduciary obligation with existing concepts of loyalty. The new loyalty is not (...) incoherent. Courts have adopted a recognizable understanding of loyal behavior - being “true” - that exists in other social spheres. Under this conception, loyal directors must not only act in the best interests of their corporation and its shareholders, they must also be honest with shareholders and comply with positive law. This Article then offers insights into the function of these expanded fiduciary duties. Although the new loyalty duties pose risks, there are good reasons to think they will provide net benefits. Following the recent Lyondell decision, it appears that the Stone case and its progeny will not result in significant revisions to the business judgment rule. However, the recent change in a director’s loyalty obligation may substantially lower information costs, giving better guidance to directors and simplifying coordination. In addition, the new conception of loyalty can also serve an important expressive function, enabling a more efficient level of trust among corporate actors, investors, and those who transact with the firm. There is a traditional view concerning the relation between mind and matter, knower and known. It posits a bifurcation between the two, maintaining, as Ryle puts it, that mind and matter are two distinct orders of existence. This traditional view comes, in large part, from Descartes. James rejects the traditional view, arguing instead for a close relationship between thought and object. His argument contains two components. The first stresses the close functional relationship between thought and object in our everyday experience. (...) James argues here that true thoughts do or can lead us to their objects, culminating in prosperous interaction with them. The second part of James's argument holds that in pure experience--the original flow of data within which all distinctions are to be made--there is no distinction yet made between mind and matter, knower and known. These distinctions arise only later as conceptual tools for bringing organization to the original presentations. Any given element of pure experience is categorized twice, once as an element of the physical world, and a second time as an element of the perceiver's own mental history. The conclusion, then, is that James: shows that thought and object work together in a close functional relationship in ordinary experience; and argues that they arise from one homogeneous pure experience. ;A number of criticisms were directed against James's view, including: Lovejoy's, arguing that the incompatibilities of thought and object preclude the possibility of their arising from one homogeneous source; Russell's and Perry's, arguing that James's theory is unable to extricate itself from idealism; Miller's and Bode's, arguing that James's view contradicts one of his own important tenets in The Principles of Psychology; and an argument that James is unable to account for the agency by means of which pure experience gets organized. ;James can reply plausibly to all of these criticisms including the difficult issue of the self. On this question a consistent understanding of James's basic assumptions is required. ;Finally, James's viewpoint offers an interesting critical perspective on certain contemporary theories of mind-brain identity. In the early months of 2020, the deadly Covid-19 disease spread rapidly around the world. In response, national and regional governments implemented a range of emergency lockdown measures, curtailing citizens’ movements and greatly limiting economic activity. More recently, as restrictions begin to be loosened or lifted entirely, the use of so-called contact tracing apps has figured prominently in many jurisdictions’ plans to reopen society. Critics have questioned the utility of such technologies on a number of fronts, both practical and ethical. (...) However, little has been said about the ways in which the normative design choices of app developers, and the products that result therefrom, might contribute to ethical reflection and wider political debate. Drawing from scholarship in critical design and human–computer interaction, this paper examines the development of a QR code-based tracking app called Zwaai (‘Wave’ in Dutch), where its designers explicitly positioned the app as an alternative to the predominant Bluetooth and GPS-based approaches. Through analyzing these designers’ choices, this paper argues that QR code infrastructures can work to surface a set ofethical–political seams, two of which are discussed here—responsibilizationandnetworked (im)permanence—that more ‘seamless’ protocols like Bluetooth actively aim to bypass, and which may go otherwise unnoticed by existing ethical frameworks. Os Lumpers defendem a suposição tradicional que há um conceito unificado de responsabilidade, enquanto os Splitters sustentam que há dois ou mais conceitos de responsabilidade moral. Aqui, eu ofereço um argumento em nome dos Splitters que conecta um tipo de pluralismo (...) de valor na ética normativa, teorizando com a contenda dos Splitters de que há múltiplas formas de responsabilidade moral. Minha tese é condicional. Na medida em que alguém crê plausível um quadro fragmentado da paisagem na teorização normativa – que eu referirei como ‘bricolagem moral’ – então alguém tem razão em juntar-se aos Splitters pensando que o conceito de responsabilidade moral é igualmente fragmentado. This essay reviews John Gardner’s recent books, From Personal Life to Private Law, and Torts and Other Wrongs. Both books offer profound insights into private law’s concerns with justice and our reasons for action. The essay focuses on Gardner’s continuity thesis, and in particular on his idea that a third party may act on behalf of a wrongdoer as her delegee. Three settings are considered. First, I will discuss settings in which the state or another third party acts to remedy (...) a wrong without the wrongdoer’s consent. Second, I will review settings in which the legal remedies at issue – e.g., general damages or punitive damages – may not fit well with the idea that the state is acting on behalf of a wrongdoer. Third, I will analyze settings in which the state may be acting on behalf of right holders, yet still be concerned with the continuity thesis. Assessing each of these contexts offers further insights into the purpose of private law remedies. (shrink)

This is a book review of Edward Grant's, _God and Reason in the Middle Ages_.

Traditional model systems such as fly, mouse, and chick have formed the foundation of the EvoDevo research program. These animal systems have provided a wealth of information on the patterns and mechanisms of developmental change over large phylogenetic scales. However, the almost exclusive focus on individual embryos as model organisms has also limited the field’s ability to address the central roles that natural selection and life history adaptation play in the evolution of developmental systems. Likewise, focus on this small set (...) of “unitary” model organisms may also constrain the explanatory reach and theoretical robustness of EvoDevo if we consider that many core developmental processes like homeostatic regulation, ontogenetic differentiation, and norms of reaction are also manifest at other levels of biological organization, such as colonial organisms. The study of social insect systems can help bridge these considerable gaps in EvoDevo’s current approach. Because social insect colonies span the fine line between simple associations of “unitary” organisms and full-fledged “superorganisms,” these systems help elucidate what kinds of processes fundamentally characterize developmental systems and their evolution. What is more, the traits of social insect colonies show high degrees of population-level variability that can be linked directly to selective factors in the environment, making them ideal systems in which to more fully integrate EcoEvoDevo approaches. The influence that philosophy of science has had on scientific practice is as controversial as it is undeniable, especially in the case of biology. The dynamic between philosophy and biology as disciplines has developed along two different lines that can be characterized as 'paternal', on the one hand, and more 'fraternal', on the other. The role Popperian principles of demarcation and falsifiability have played in both the systematics community as well as the ongoing evolution-creation debates illustrate these contrasting forms of (...) interdisciplinary engagement, underscoring the influence philosophy of science in shaping our contemporary understanding of biology in the North American context. However, a strict disciplinary distinction between philosophy and science may itself be a false dichotomy that risks hampering future development of the biological sciences. By actively engaging with philosophical considerations as an integral part of their scientific practice, nineteenth-century biologists offer an interesting counterpoint to current trends of overspecialization and provide a model of scientists who avoided extremes of antagonism with, or subservience to, philosophy. A vivacious biography of the prophetic and sympathetic philosopher who along with Voltaire and Rousseau built the foundations of the modern world, and travelled as far as Russia to enlighten the Tsarina Catherine the Great. Denis Diderot is often associated with the decades-long battle to bring the world's first comprehensive Encyclopédie into existence. But his most compelling and personal writing took place in the shadows. Thrown into prison for his atheism in 1749, Diderot decided to reserve his most daring books (...) for posterity-for us, in fact. In the astonishing cache of unpublished writings that he left behind after his death, Diderot dreamed of natural selection before Darwin, the Oedipus complex before Freud, and genetic manipulation centuries before Dolly the Sheep was born. Even more audaciously, the writer challenged virtually all of his century's accepted truths, from the sanctity of monarchy, to the racial justification of slave trade, to the limits of human sexuality. He was also keenly aware of the dangers of absolute power, about which he wrote so persuasively that it led Catherine the Great not only to support him financially but also to invite him to St. Petersburg. In this thematically organized biography, Andrew Curran vividly describes Diderot's tormented relationship with Rousseau, his feud with Voltaire, his tortured marriage, his passionate affairs, and his often-paradoxical stand on art, morality, and religion. But what this book brings out most brilliantly is how a man's character flaws and limitations are often the flip side of his genius and his ability to break taboos, dogmas, and conventions. (shrink)

Early theorists speculated that extremely shy children, or those with anxious temperament, were likely to have anxiety problems as adults. More recent studies demonstrate that these children have heightened responses to potentially threatening situations reacting with intense defensive responses that are characterized by behavioral inhibition and physiological arousal. Confirming the earlier impressions, data now demonstrate that children with this disposition are at increased risk to develop anxiety, depression, and comorbid substance abuse. Additional key features of anxious temperament are that it (...) appears at a young age, it is a stable characteristic of individuals, and even in non-threatening environments it is associated with increased psychic anxiety and somatic tension. To understand the neural underpinnings of anxious temperament, we performed imaging studies with 18- fluoro-deoxyglucose high-resolution Positron Emission Tomography in young rhesus monkeys. Rhesus monkeys were used because they provide a well validated model of anxious temperament for studies that cannot be performed in human children. Imaging the same animal in stressful and secure contexts, we examined the relation between regional metabolic brain activity and a trait-like measure of anxious temperament that encompasses measures of BI and pituitaryadrenal reactivity. Regardless of context, results demonstrated a trait-like pattern of brain activity that is predictive of individual phenotypic differences. Importantly, individuals with extreme anxious temperament also displayed increased activity of this circuit when assessed in the security of their home environment. These findings suggest that increased activity of this circuit early in life mediates the childhood temperamental risk to develop anxiety and depression. (shrink)

The goal of this paper is to review and describe the characteristics and outcomes of ethics consultations on a gastrointestinal oncology service and to identify areas for systems improvement and staff education. This is a retrospective case series derived from a prospectively-maintained database of the ethics consultation service at Memorial Sloan Kettering Cancer Center. The study analyzed all ethics consultations requested for patients on the gastrointestinal medical oncology service from September 2007 to January 2016. A total of 64 patients were (...) identified. The most common primary ethical issue was the DNR order, followed by medical futility. The most common contextual issues were dispute/conflict between staff and family, dispute/conflict intra-family, and cultural/ethnic/religious issues. The majority of ethical issues leading to consultation were resolved ; i.e., the patient, surrogate, and/or healthcare team followed the recommendation of the ethics consultant. 22% had a DNR order prior to the ethics consult and 69% had a DNR order after the consult. In this population of patients on a gastrointestinal oncology service, ethics consultations are most often called regarding patients with advanced cancers and the most common ethical conflicts arose between families and the health care team over goals of care at the end of life, specifically related to the DNR order and perceived futility of continued/escalation of treatment. Ethics consultations assisted with conflict resolution. Conflicts might be reduced with improved communication about prognosis and earlier end of life care planning. (shrink)

Data science is characterized by engaging heterogeneous data to tackle real world questions and problems. But data science has no data of its own and must seek it within real world domains. We call this search for data “prospecting” and argue that the dynamics of prospecting are pervasive in, even characteristic of, data science. Prospecting aims to render the data, knowledge, expertise, and practices of worldly domains available and tractable to data science method and epistemology. Prospecting precedes data synthesis, analysis, (...) or visualization, and is constituted by the upstream work of discovering disordered or inaccessible data resources, thereafter to be ordered and rendered available for computation. Through this work, data science positions itself in the middle of all things—capable of engaging this, that, or any domain—and thus prospecting is a key driver of data science’s ongoing formation as a universal science. Hume’s understanding of sympathy in section 2.1.11 of the Treatise—that it is a mental mechanism by means of which one sentient being can come to share the psychological states of another—has a particularly interesting implication. What the sympathizer receives, according to this definition, is the passing psychological “affection” that the object of his sympathy was experiencing at the moment of observation. Thus the psychological connection produced by Humean sympathy is not between the sympathizer and the “other” as a “whole person” (...) existing through time, but between the sympathizer and the other’s current mental state, detached from his or her diachronic psychological life. Some commentators profess themselves dissatisfied with the impersonality of this “limited sympathy”. John Bricke, for example, argues that the Humean sympathizer sympathizes with “atomistically rendered desires of some individual who is, thus far, of no further concern,” while Philip Mercer writes more bluntly that Hume’s definition omits the “practical concern for the other” that is the essence of sympathy’s contribution to moral psychology.
